Final Approval

Final approval is the court’s decision approving a class action settlement after reviewing whether its terms meet the applicable fairness standard. In federal court, Federal Rule of Civil Procedure 23(e) requires a hearing and a finding that a settlement binding class members is fair, reasonable and adequate. The review includes the adequacy of representation, the negotiated relief and how class members are treated relative to one another.

Three phrases describe different stages. A motion for final approval is a request for the court’s decision. A final approval hearing is the proceeding where the court considers that request. An order granting final approval records the decision itself. A scheduled hearing or filed motion does not mean approval has already been granted.

For someone awaiting money, final approval is a milestone rather than a payment date. The agreement may make its effective date depend on appeal-related conditions, and claims review or distribution arrangements can remain outstanding. For example, the BCBS subscriber settlement received final approval in August 2022, while its separate distribution order was issued in April 2026. The Eleventh Circuit’s BCBS decision also illustrates that a final approval ruling can undergo appellate review.

Preliminary approval is an earlier step that allows notice and further settlement review to proceed. Final approval is distinct from both that preliminary decision and an individual claim’s acceptance. Your payment still depends on the applicable class definition, claim requirements and distribution terms.

Keep the approval order, effective date, filing deadline and payment schedule separate when reading a notice. Approval alone does not reopen a closed claims period or establish the amount you will receive. State-court procedures can differ, so the governing rules and case documents determine the details.
