Net settlement fund is the money available for distribution after the deductions specified in a settlement agreement and court orders are taken from the fund. Those deductions may include approved attorney fees, litigation expenses, notice and administration costs, taxes owed by the fund, and permitted awards to class representatives.

The exact calculation belongs to the individual settlement. For example, an agreement filed in the U.S. District Court for the Middle District of North Carolina defines the net fund by subtracting specified fees, expenses, taxes, and other court-approved deductions. An agreement may reserve money for costs that are still expected, rather than wait until every expense has been paid.
The headline amount needs context. Some costs may be paid separately by the defendant, and a fund may earn interest. The net amount therefore cannot be calculated from the headline alone or by applying a standard attorney-fee percentage. Federal Rule of Civil Procedure 23 provides for review of fee awards in federal class actions, including arrangements where fees come from the fund or are otherwise paid.
As a hypothetical example, a $7.5 million fund with $2.5 million in deductions would leave $5 million for distribution. That does not establish any one person’s payment. The approved allocation plan may divide the money equally or use qualifying purchases, recognized losses, work periods, or other factors. More valid claims can reduce a proportional share, but payment caps and separate benefit pools can affect the result.
A net fund also does not tell you whether a claim form is required. Some settlements pay identified class members automatically, while others require a timely, valid submission.
