Payment Election
A payment election is a claimant’s or settlement recipient’s selection of how to receive money from the payment methods offered by the settlement administrator. Depending on the settlement, the available choices may include a paper check, an automated clearing house transfer, a digital wallet, or a virtual prepaid card.
A payment election concerns delivery of the money. It is different from filing a claim, opting out, objecting, or deciding whether to accept settlement terms. Some settlements ask for the election on the claim form, while others send a payment-selection email after claims have been approved. Some automatic-payment settlements may also let recipients choose between an electronic payment and a check.
Not every settlement offers every method. The Federal Trade Commission’s refund guidance, for example, lists checks, prepaid debit cards, PayPal, and Zelle among the methods used in its programs. A private class action settlement may offer a different combination.
Before making a payment election, check
What account, email address, or mailing address will receive the payment
Whether a digital card has an activation or expiration date
Whether any transaction or replacement fees apply
What happens if no election is made by the deadline
Whether the administrator permits changes after submission
No method is automatically fastest in every settlement. Distribution timing depends on final approval, appeals, claim review, the administrator’s schedule, and the terms governing each payment option. Incorrect account or contact information can also cause a payment to fail or require reissue.
If you make a mistake or do not receive the selected payment, contact the settlement administrator through the official settlement website. The administrator may be able to update the election, reissue the payment, or provide another method, but the available remedy depends on the settlement.
A payment election does not determine whether settlement money is taxable. According to the Internal Revenue Service, tax treatment generally depends on what the payment was intended to replace and whether an exclusion applies. An administrator may request a Form W-9 when it needs a correct taxpayer identification number for information reporting, but that request is tied to reporting obligations rather than choosing a check or electronic payment.
Only enter bank or wallet information through a verified administrator page or other method identified in the official notice. A legitimate payment election should not require an upfront fee to release settlement money.
